In 12 states (California,
Connecticut, Florida, Illinois, Maryland, Massachusetts, Michigan,
Montana, Nevada, New Hampshire, Pennsylvania, and Washington) you're
required to get the permission of all parties on the line before
making any kind of recording. In the rest of the country, any single
member that's part of the conversation can legally record it without
consent from the other parties.
"two party consent" states,
the client has to have all of the employees sign a statement that
they know that they may be recorded at any time for training and
quality control purposes. The video/audio MSCs are well aware of
this. If you are concerned, just ask the MSC to confirm that the
client had the required consent forms on file.
Audio taping without permission of the other party is illegal in Florida and other stated States [look up your local State law] . Video taping apparently is OK if it has no audio. This state law is couched with some caveat about it being "illegal except in the pursuit of law" or by law enforcement or some similar language. I would not complete recorded shops---phone or in person---without absolute confirmation in writing from the MS company that all required permissions were on file.
